Terms of Service

By completing a booking through hushandtrim.com you agree to the following terms. Please read them before booking.

1. Booking and Payment

All services are priced on a flat-fee basis. Prices are displayed at booking and are based on the lot size or services you selected. Your card details are collected at booking and your card is charged when your visit is completed. No payment is required upfront.

We verify all lot sizes using public parcel data prior to your first visit. If we notice a significant discrepancy, we will touch base with you before we arrive.

2. Cancellation Policy

You may cancel your booking at any time before your technician arrives at no charge. If we cancel your visit due to equipment issues, weather conditions, or circumstances on our end, you will not be charged.

3. Lawn Readiness

To ensure a quality result and protect our equipment, your lawn should be ready for service at the time of our arrival.

Grass height: We will not mow grass shorter than 3 inches. Cutting shorter stresses the turf, damages root systems, and encourages weed growth. If your lawn is too short when we arrive, we will offer to reschedule at no charge, push your next visit back, or skip the cycle. We reserve the right to adjust our service time or decline to mow if the property requires significantly more work than indicated at booking, including grass that is excessively overgrown. If we are unable to complete the service as booked, we will contact you to discuss options. No charge if we cannot proceed.

Pet waste: If unmanaged pet waste is present on the lawn and Pet Waste Cleanup has not been booked, we will not mow and will reach out to reschedule at no charge. If you have booked Pet Waste Cleanup, our technician will clear the lawn before mowing. No preparation is required on your end.

Sticks and debris: Minor sticks and small debris are not a problem. We will move them aside as needed. If your lawn has significant debris such as fallen branches or storm accumulation that would require more than a few minutes to clear, we will not mow and will reach out to reschedule at no charge. We do not offer debris hauling of any kind. If you are unsure whether your property is ready, note it in your booking form and we will confirm before your visit.

4. Debris and Clippings

Grass clippings are dispersed back into your lawn following each mow, where they decompose and return nutrients to the soil. Hard surfaces including driveways, walkways, and patios are blown clean at the end of each visit. We do not collect, bag, or haul yard debris of any kind.

5. Eco-Pressure Washing

Our pressure washing service uses battery-powered equipment and water only. No chemicals or detergents are used. This service is provided in a 20-minute block. We do not guarantee completion of a specific area within that time.

You are responsible for ensuring an outdoor water spigot is accessible and turned on at the time of service. If trash or recycling bins are being washed, they must be empty at the time of service. If access to water is not available upon arrival, the service cannot be performed and we will reach out to reschedule at no charge.

6. Plant Watering

Our plant watering service provides 15 minutes of active watering using your outdoor spigot and hose. This service covers exterior container and potted plants only. We do not water in-ground beds or vegetable gardens.

You are responsible for ensuring outdoor water is turned on and a hose is accessible at the time of service. If water access is not available upon arrival, the service cannot be performed and we will reach out to reschedule at no charge.

7. Pets and Animals

Please keep dogs and other outdoor pets secured indoors or in a contained area during our visit. If your dog will be in an unfenced area, please note this in your booking form so we can coordinate on arrival. If a pet is unsecured and poses a safety concern upon our arrival, we reserve the right to reschedule the visit at no charge.

8. Weather

Light rain does not affect most services. If weather conditions would result in a poor outcome or unsafe work, we will contact you to reschedule at no charge.

9. Inaccessible Property

If our technician arrives and cannot access your property due to a locked gate, blocked entrance, or other condition not disclosed at booking, we will attempt to reach you. If we cannot gain access within 15 minutes of arrival, the visit will be cancelled at no charge and we will reach out to reschedule.

10. Satisfaction Guarantee

If you are not satisfied with the result of your visit, contact us within 24 hours and we will return to address any issues at no charge. If we are unable to meet your expectations after our return visit, you will not be charged for that visit.

11. Habitat Credit

Customers who maintain an active pollinator patch on their property are eligible for a $10 discount on any visit over $25. A pollinator patch is defined as a dedicated area of native plantings left unmowed and free of synthetic pesticides. Check the appropriate box in your booking form. Our technician will verify the patch on your first visit. If the patch does not exist or does not meet our criteria, the discount will not be applied.

12. Gift Certificates

Gift certificates are non-refundable after purchase. They have no expiration date and may be redeemed for any service at any time. Gift certificates have no cash value and cannot be exchanged for cash.

13. Service Area

We serve residential and commercial properties within Berkshire County, Massachusetts, including Lenox, Stockbridge, Pittsfield, Great Barrington, Lee, Williamstown, and surrounding communities. If your property is outside our service area, your booking will be cancelled at no charge.

14. Property Access and Liability

You are responsible for ensuring our technician has safe and unobstructed access to your property...

  • Property Boundaries: The Customer is solely responsible for identifying and marking the exact physical boundaries of their property. Hush & Trim accepts zero liability for disputes, property damage, or trespass claims arising from inaccurate boundary descriptions provided by the Customer.

  • Subsurface and Structural Hazards: Hush & Trim is not responsible for damage caused by pre-existing conditions... including but not limited to buried irrigation, invisible dog fencing, shallow utility lines, or unmarked structural hazards.

  • Site Conditions and Hidden Debris: For any grading, seeding, or reclamation work, the Customer warrants the site is free of hazardous materials, underground obstructions, or illegally dumped debris. Hush & Trim is not liable for equipment damage or delays caused by hidden site conditions not disclosed at booking.

Hush & Trim carries general liability insurance. A certificate of insurance is available upon request.

15. Changes to Services

We reserve the right to adjust our service offerings, pricing, and availability at any time. Changes will not affect bookings already confirmed. Updated terms will be posted at hushandtrim.com and will take effect for new bookings made after the update date.

16. Liability

Our liability for any claim arising from a service visit is limited to the amount charged for that visit. We are not responsible for indirect or consequential damages. Any concern about the quality of a completed visit must be raised within 24 hours so we have the opportunity to make it right.

  • Third-Party Claims: The Customer agrees to indemnify and hold harmless Hush & Trim and its technicians against any and all claims, damages, liabilities, costs, or expenses (including reasonable attorney's fees) arising from third-party claims (including neighbors or municipal boards) related to services performed within the boundaries designated by the Customer.

17. Governing Law

These terms are governed by the laws of the Commonwealth of Massachusetts. Any disputes arising from these terms or from services provided by Hush & Trim shall be subject to the jurisdiction of the courts of Berkshire County, Massachusetts.

19. Environmental, Municipal, and Regulatory Compliance

The Customer warrants that the property complies with all local, municipal, state, and federal laws, bylaws, and regulations, including but not limited to the Massachusetts Wetlands Protection Act (M.G.L. c. 131, § 40) and local Conservation Commission bylaws.

  • Permits and Approvals: The Customer assumes 100% responsibility for identifying, obtaining, and maintaining any required municipal filings, permits, Requests for Determination of Applicability (RDA), Notices of Intent (NOI), or Orders of Conditions required for any work on the property.

  • Indemnification against Fines: If Hush & Trim is fined, cited, penalized, or subject to a stop-work order by any municipal board, town agent, Conservation Commission, or state agency due to unpermitted or illegal conditions on the Customer's property, the Customer agrees to fully indemnify, defend, and hold harmless Hush & Trim. The Customer shall assume full financial liability for all associated fines, legal fees, court costs, and lost revenue resulting from such regulatory actions.

20. Right to Refuse or Suspend Service

Hush & Trim reserves the right to immediately suspend or terminate service on any property if, in our sole professional judgment, proceeding with the work would violate local or state environmental laws, pose an undue safety risk to our crew, or expose our business to regulatory liability. In the event of a suspension under this section, the Customer remains liable for any work completed up to the time of suspension.
